When you do a power of attorney Surrey form, commonly called POAs, you are giving the right for someone who you have chosen to perform business decisions on your behalf. Depending on why you want them to act like this and want you really want them to do, will affect the type of form that you will use. There are generally three different ones used. Durable, Non-durable, and Spring POAs.
A Durable POA is one that allows the person that you have assigned as your representative to act on your behalf after you have become mentally disabled. This can happen for couple of reasons. You might have an unfortunate incident such as a car accident, or a disease has affected your brain negatively.
The Non-durable one would actually expire if you lost your ability to think well. These ones are used more for a specific occasion, such as having someone act on your behalf for a particular real estate transaction. You might be out of town or temporarily incapacitated and you need someone who can step in and take your place.
Then there is the Springing POA. This becomes effective when a certain incident happens. In he case of the brain injury, you could have previously prepared to document and signed, but the person who you have chosen to serve in your place would not be able to do so without you suffering an injury that left you unable to act on your own behalf.
The reasons for using these forms are all the same in the sense that they allow someone to act on your behalf. All three expire at the time of your death.
Perhaps the most important thing before you sign one is to make sure that the person you have chosen will handle this situation responsibly and not taken advantage of it for their own gain. This will make sure you are protected when you might need it most.
